Two-Brain Coaching Terms of Purchase


YOUR ACCEPTANCE OF THESE TERMS OF PURCHASE

These Terms of Purchase apply to all purchasers of Two-Brain Coaching Incorporated products. By purchasing Two-Brain Coaching products, you are agreeing to comply with and be bound by these Terms of Purchase. If you do not agree to these Terms, do not purchase Two-Brain Coaching products.

YOUR OBLIGATIONS

In consideration of your purchase of Two-Brain Coaching products, you will abide by all terms of purchase, site and privacy policy requirements.  Further, you agree that to the extent you provide personal information to Two-Brain Coaching it will be true, accurate, current, and complete and that you will update all personal information as necessary.

PRIVACY POLICY

All contact and permission (including data capture and usage by Two-Brain Coaching) is authorized by our Privacy Policy posted on the Two-Brain Coaching Websites.

ACCOUNT ACCESS & REQUIREMENTS

All purchases will be made available to the Purchaser through a unique access account on the Two-Brain Coaching website.  Sharing of any account logins or providing of access to unauthorized individuals will result in suspension of account, revocation of access and all monies will be forfeited with no refunds available.  Authorized individuals include product purchaser as specified in product descriptions. All authorized individuals are bound by the NDA agreements in these terms.

Videos hosted within the account shall not be downloaded, screen-recorded or otherwise captured in any format.

Videos are only to be accessed by your unique log-in account to the Two-Brain Coaching website.

SUBSCRIPTION PRODUCTS

Subscription products after the initial subscription purchase, provide access to the applicable ongoing online modules and monthly call(s). Upon cancelling a subscription product, access to applicable online modules, mentoring calls, and Facebook Private Groups will be removed.

REFUNDS

There are NO REFUNDS once payment has been processed. Cancellation details are listed for each product below.

FAILURE TO MEET FINANCING TERMS OR DELINQUENCY OF PAYMENTS

Access to all relevant products will be removed if you are in default of financing terms or you are delinquent on payments due to Two-Brain Coaching.

FIRST DEGREE COURSE

The First Degree Course is a combination of services which includes: (3) one-on-one mentoring calls with a Two-Brain Coaching Mentor, Unlimited Email Support, and Access to the online First Degree Course, with video modules and templates. This program is typically completed in 4-6 weeks. 

To be eligible for the “First Degree Course” product you must complete purchase of said product. All purchasers of the First Degree Course will receive access to the most current online course for that purchasers’ segment. Provided you are not in violation of any terms laid out further in this agreement, you will retain lifetime access to the First Degree Course. 

Access to the online course, mentor calls, and further benefits above are granted only to the purchasing individual. Access does not transfer to any other individuals within the organization, even the owner of the gym, unless he or she purchases a separate access point. 

All purchasers of the First Degree Course will receive three (3) sixty (60) minute mentor calls.

Cancelling or changing an appointment must be completed 24 hours in advance so we can make your spot available to another coach who needs it. If you don't cancel 24 hours in advance, you'll forfeit the call, and your mentor will assign extra work on the next call, if able, to get you caught up. First Degree must be fully completed before continuing to either option of the Second Degree Course.

Purchasers who successfully complete the quiz at the end of the First Degree Course will receive a Certificate of Completion, signifying that they are a ‘Certified First Degree Coach.’ 

SECOND DEGREE (IN-PERSON GROUP COACHING) COURSE 

The Second Degree (In-Person Group Coaching) Course is a combination of services which includes: (3) one-on-one mentoring calls with a Two-Brain Coaching Mentor, Unlimited Email Support, and Access to the online Second Degree (In-Person Group Coaching) Course, with video modules and templates. This program is typically completed in 4-6 weeks. 

To be eligible for the “Second Degree (In-Person Group Coaching) Course” product you must complete purchase of said product. All purchasers of the Second Degree (In-Person Group Coaching) Course will receive access to the most current online course for that purchasers’ segment. Provided you are not in violation of any terms laid out further in this agreement, you will retain lifetime access to the Second Degree (In-Person Group Coaching) Course. 

Access to the online course, mentor calls, and further benefits above are granted only to the purchasing individual. Access does not transfer to any other individuals within the organization, even the owner of the gym, unless he or she purchases a separate access point. 

All purchasers of the Second Degree (In-Person Group Coaching) Course will receive three (3) sixty (60) minute mentor calls.

SECOND DEGREE (ONLINE COACHING) COURSE 

The Second Degree (Online Coaching) Course is a combination of services which includes: (6) one-on-one mentoring calls with a Two-Brain Coaching Mentor, Unlimited Email Support, and Access to the online Second Degree (Online Coaching) Course, with video modules and templates. This program is typically completed in 4-6 weeks. 

To be eligible for the “Second Degree (Online Coaching) Course” product you must complete purchase of said product. All purchasers of the Second Degree (Online Coaching) Course will receive access to the most current online course for that purchasers’ segment. Provided you are not in violation of any terms laid out further in this agreement, you will retain lifetime access to the Second Degree (Online Coaching) Course. 

Access to the online course, mentor calls, and further benefits above are granted only to the purchasing individual. Access does not transfer to any other individuals within the organization, even the owner of the gym, unless he or she purchases a separate access point. 

All purchasers of the Second Degree (Online Coaching) Course will receive six (6) thirty (30) minute mentor calls.

Cancelling or changing an appointment must be completed 24 hours in advance so we can make your spot available to another coach who needs it. If you don't cancel 24 hours in advance, you'll forfeit the call, and your mentor will assign extra work on the next call, if able, to get you caught up. 

Purchasers who successfully complete the quiz at the end of the Second Degree (Online Coaching) Course will receive a Certificate of Completion, signifying that they are a ‘Certified Second Degree Coach.’ 

NUTRITION COACHING COURSE 

The Nutrition Coaching Course is a combination of services which includes: (3) one-on-one mentoring calls with a Two-Brain Coaching Mentor, Unlimited Email Support, and Access to the online Nutrition Coaching Course, with video modules and templates. This program is typically completed in 4-6 weeks. 

To be eligible for the “Nutrition Coaching Course” product you must complete purchase of said product. All purchasers of the Nutrition Coaching Course will receive access to the most current online course for that purchasers’ segment. Provided you are not in violation of any terms laid out further in this agreement, you will retain lifetime access to the Nutrition Coaching Course. 

Access to the online course, mentor calls, and further benefits above are granted only to the purchasing individual. Access does not transfer to any other individuals within the organization, even the owner of the gym, unless he or she purchases a separate access point. 

All purchasers of the Nutrition Coaching Course will receive three (3) sixty (60) minute mentor calls. To clarify, this course option is for one (1) person only. In addition to the mentoring calls mentioned above, this one person will be given: one (1) course access and one (1) Certificate of Completion.

Cancelling or changing an appointment must be completed 24 hours in advance so we can make your spot available to another coach who needs it. If you don't cancel 24 hours in advance, you'll forfeit the call, and your mentor will assign extra work on the next call, if able, to get you caught up. 

Purchasers who successfully complete the quiz at the end of the Nutrition Coaching Course will receive a Certificate of Completion. 

NUTRITION COACHING PLUS COURSE 

The Nutrition Coaching Plus Course is a combination of services which includes: (3) one-on-one mentoring calls with a Two-Brain Coaching Mentor, Unlimited Email Support, and two (2) access points to the online Nutrition Coaching Course (one (1) Nutrition Coach and one (1) owner), with video modules and templates. This program is typically completed in 4-6 weeks. 

To be eligible for the “Nutrition Coaching Plus Course” product you must complete purchase of said product. All purchasers of the Nutrition Coaching Course will receive access to the most current online course for that purchasers’ segment. Provided you are not in violation of any terms laid out further in this agreement, you will retain lifetime access to the Nutrition Coaching Course. 

Access to the online course, mentor calls, and further benefits above are granted only to the purchasing individual. This course specifically grants purchaser two (2) access points - one (1) for a coach and one (1) for the gym owner.

This course purchase option still provides for three (3) sixty (60) minute mentor calls, which can be attended by just the Nutrition Coach, or the Nutrition Coach and Owner together (shared mentoring call). To clarify, this course is for two (2) people only, but it can only be one (1) nutrition coach and one (1) owner. Each respective party previously mentioned will receive one (1) access to the Online Course.

Cancelling or changing an appointment must be completed 24 hours in advance so we can make your spot available to another coach who needs it. If you don't cancel 24 hours in advance, you'll forfeit the call, and your mentor will assign extra work on the next call, if able, to get you caught up. 

Purchasers who successfully complete the quiz at the end of the Nutrition Coaching Course will receive a Certificate of Completion. Only 1 Certificate of Completion is awarded with the Nutrition Coaching Plus Course, assigned to the designated Nutrition Coach who completes the final exam.

EXTRA MENTORING CALL PURCHASE

The option to purchase additional mentoring calls with a Two-Brain Coaching mentor is available to those individuals who have successfully completed one of the aforementioned courses above. This benefit may not be extended to any other coaches or individuals who have not previously completed one of the eligible Two-Brain Coaching Courses outline above.

To be eligible for any Extra Mentoring Calls you must have purchased the appropriate ‘Extra Mentoring Call’ product. You will be allowed to book with any mentor from the course(s) you have completed. For example, if you have not completed the Second Degree Course, you would be ineligible to have a call with a Second Degree Mentor. 

The only individuals eligible for these calls are those who successfully completed the course for which they are receiving additional mentorship. 

Calls must be used within the timeframe laid out below. There are no refunds for unused calls. 

Monthly Ongoing - you have (30) thirty days from date of purchase to use this

Three (3) pack - you must use all of these within six (6) months of purchase

Six (6) pack - you must use all of these within twelve (12) months of purchase

Extra Mentoring Call length is sixty (60) minutes.

 

FACEBOOK COMMUNITY RULES

The primary intention of the various Two-Brain Coaching Facebook Groups are to stay connected to fellow coaches, share ideas, support and form genuine connections. It’s not a place to find customers or recruit people to other programs or groups. Failure to honor and uphold the Community Rules will result in your removal from the Group and participation in Two-Brain Coaching products may also be revoked without refund.

By joining the eligible Two-Brain Coaching Facebook Groups, you agree to the Group Guidelines which include, but are not limited to:

  • No Pitching: You are not permitted to offer your services, sell your programs or products, share affiliate links or direct group members to blog posts with your offers/affiliate offers or publicly ask members to join your own Facebook groups or communities.
  • No Unsolicited Private Messages: Be cautious of sending unsolicited private messages to group members. If we receive multiple complaints that you or someone else is using private messages to make unsolicited pitches to members, you may be asked to leave. You should view the group as your peers, not your leads.
  • Be Respectful: Because of the diversity of our global community, please keep in mind that something that may be disagreeable or disturbing to you may not violate our community guidelines. Comments that are inappropriately negative, rude, or attacking will be deleted, removed, or we will ask you to revise your thoughts. Everyone is here to learn and grow, so anything violating that will be removed.

LICENSE OF USE

So long as you comply with this Terms of Purchase, Two-Brain Coaching grants you a non-exclusive, non-transferable license to download, view, edit, copy and print the Products you purchase solely for your individual use with respect to your gym or similar business use, and which is not to include any reproduction, copying, or any other use of the Products or free downloadable material for resale or distribution (“Permitted Use”), provided that you: (1) abide by all copyright protections afforded to the Products, both as formally registered with the U.S. Copyright Office and as otherwise provided by law; (2) abide by all trademark protections afforded to the Products, both as formally registered with the U.S. Patent and Trademark Office, a state trademark authority, or as otherwise provided by common law; (3) do not use the Products or otherwise offer them on any other website, through a networked computer environment, or otherwise offer them for distribution or sale or in any manner inconsistent with Permitted Use as provided by these Terms; and (4) do not modify the Products in any way beyond edits and completions necessary to complete templates and other Products consistent with Permitted Use provided by these Terms.  Final products using templates and/or processing may be shared in their final version.

Such permission to modify Products consistent with Permitted Use in no way expands the limited license provided herein, nor does grant you intellectual property ownership in, or provide a general right to modification of, the Products.

Violation of this License will result in immediate ejection from the community, denial of access to all purchases and all monies paid will be forfeited without refund.  Two-Brain Coaching may, at its discretion, pursue all legal remedies available for violations.

NO WARRANTIES

PRODUCTS ARE PROVIDED “AS IS”. Two-Brain Coaching OFFERS NO WARRANTY, EXPLICIT OR IMPLIED, REGARDING ANY FORMS OR TEMPLATES, THE ACCURACY OF ANY INFORMATION, OR ANY RIGHTS OR LICENSES UNDER THIS AGREEMENT INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. OBTAINING MATERIALS AVAILABLE THROUGH Two-Brain Coaching IS DONE AT YOUR OWN DISCRETION AND AT YOUR OWN RISK. Two-Brain Coaching MAKES NO WARRANTY THAT THE SITES, PRODUCTS OR MATERIALS WILL BE ACCURATE AND RELIABLE IN ALL INSTANCES. LIMITATION OF LIABILITY AND INDEMNIFICATION EXCEPT AS PROHIBITED BY LAW, Two-Brain Coaching SHALL NOT BE LIABLE TO YOU OR TO ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR LOST PROFITS OR ANY OTHER DAMAGES, COSTS OR LOSSES ARISING OUT OF YOUR USE OF THE WEBSITE, MATERIALS OR PRODUCTS, INCLUDING ATTORNEY’S FEES AND RELATED EXPENSES OF LITIGATION AND ARBITRATION. EXCEPT AS PROHIBITED AS LAW, TO THE EXTENT THERE IS LIABILITY FOUND AS TO Two-Brain Coaching, SUCH RECOVERY IS LIMITED TO THE AMOUNT YOU PAID FOR MATERIALS, PRODUCTS AND SERVICES.

INDEMNITY

You agree to indemnify, defend and hold harmless Two-Brain Coaching harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of products in violation of these Terms of Purchase and/or arising from a breach of these Terms of Purchase and/or any breach of your representations and warranties set forth above and/or if any material that you post using Two-Brain Coaching products causes us to be liable to another.

SEVERABILITY

If any provision of these Terms of Purchase is held by a court of competent jurisdiction to be contrary to law, such provision will be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of these Terms of Purchase will remain in full force and effect.

GOVERNING LAW, JURISDICTION AND VENUE

These Terms of Purchase will be governed under the laws of the State of Florida without regard to its conflicts of law provisions. All actions or proceedings arising out of or relating to these Terms of Purchase will be venued exclusively in state or federal court in the State of Florida. You hereby irrevocably consent and submit to the personal jurisdiction of said courts for all such purposes. However, we retain the right to bring legal proceedings in any jurisdiction where we believe that infringement of these Terms of Purchase is taking place or originating. If either party to this agreement brings a legal action against the other party to these Terms to secure the specific performance of the Terms, collect damages for breach of this agreement, or otherwise enforce or interpret these Terms, the prevailing party will recover reasonable attorney’s fees and all costs, premiums for bonds, fees, and other expenses expended or incurred in the action in addition to any other relief that may be awarded.

THESE TERMS OF PURCHASE MAY CHANGE

These Terms of Purchase are current as of the posting date on the Two-Brain Coaching websites. Two-Brain Coaching reserves the right to change and repost these Terms of Purchase from time to time consistent with applicable laws and principles. These changes will be effective as of the date we post the revised version on the Two-Brain Coaching websites. Your continued use of Two-Brain Coaching products after we have posted the revised Terms of Purchase constitutes your agreement to be bound by the revised Terms of Purchase. If at any time you choose not to accept these Terms of Purchase, you should not use Two-Brain Coaching products.

ENTIRE AGREEMENT

These Terms of Purchase (together with our Privacy Policy and any Privacy Notices or click-through agreements applicable to you) contain the entire understanding and agreement between you and Two-Brain Coaching with respect to Two-Brain Coaching products and supersede all previous communications, negotiations, and agreements, whether oral, written, or electronic, between you and Two-Brain Coaching with respect to Two-Brain Coaching products and your use of Two-Brain Coaching products.

DEFINITIONS

The term “Products” refers to all of intellectual property to be delivered by purchased access to the purchaser.   Products include, but are not limited to, video recordings, templates, and PDF formatted documents. All products are subject to Copyright laws, and any reproduction of such will be punishable by law.

The terms “Two-Brain Coaching Inc,” "Two-Brain Coaching", “Two-Brain,” “we,” “us,” and “our” refer to Two-Brain Coaching Incorporated.

The term “including” means “including, but not limited to.”

The term “Site” refers to any website owned by Two-Brain Coaching on which these Terms of Purchase are posted.

The term “Mentoring Calls” means any call with a coaching mentor specific to the purchased product. A mentor call is defined by the product terms. During a Mentor Call a Mentor provides guidance through coaching education, product content, etc.
